Hasbro does feel a need slap faction symbols on everyone (Unicron sure isn't a Decepticon), but it is a good indicator of their alignment (good or evil). And since Skullitron is most likely not in the movie to begin with we're left believing he's just another Decepticon until some fiction says otherwise.

Also, this whole faction thing may be just strange, but we can't put it past Steelbane and Infernicus to be bots (or good guy aligned). The monsters that look like Infernicus are charging a purple eyed Prime, making me think they are meant to be good guys attacking an evil Prime, just dying in the process. And Steelbane appears to be the character on that one movie poster, so he could be considered good too. Just like how Skullitron could be the bad guy version of Steelbane seen punching Prime in trailers, hence bad guy aligned.
Also, I watched the Emgo review of Steelbane last night and he is a definite nope

Never said you did but I'm stating that I'm going to compare all of the recent packaging.
So what's different between your examples and TLK?

It's a packaging thing and Skullitron is clearly one of the same knights Steelbane is part of so he can't be related to Megatron's Decepticons unless he joins them in the movie and it could always just a a two pack with Bomber Megatron or someone else.
Also character's without factions have been labeled as one or the other in their toys such as Lockdown and packaging mistakes are also a thing look at Tr Soundwave and Broadside's faction symbols on the top of their boxes.

Skullitron and Steelbane are clearly part of the same group considering the trailers and their boxes both giving them the same jobs.

For those with a Westfield shopping centre near them, some people have been seeing this week, two short promo videos on their advertising screens, for the Transformers movie, featuring Deluxe Bumblebee (in one) and Voyager Optimus (in the other).
Both promo clips go for 10 seconds, starting off with the movie logo and its release date in Australia (June 22nd)... then it shows the feature character, morphing from the recent 3D movie promos on facebook into their first wave toy... running and transforming into vehicle mode, then transforming back to take place in a line-up of the six Deluxe and Voyager wave 1 toys.
These promo clips might show up on youtube or facebook by Hasbro or Paramount, but here is a taping of the two clips that I took today at the Garden City Westfield (outside Target)..
